Unlike the other pages in this Regional Disclosures hub, this page does not describe an exception or addition to Spark's master documents — it describes the home framework those documents are already built on. BeBulbed Spark is an Australian venture, and the Privacy Act 1988 (Cth) and Australian Privacy Principles ("APPs") are the primary privacy standard applied in our master Privacy Policy, and Australian law is the governing law of our master Terms of Service. This page consolidates that home-jurisdiction detail in one place for Australian users.

1. Australia Is Spark's Home Jurisdiction

Spark is operated by BeBulbed Spark (ABN 79 434 618 910), pending formal incorporation as an Australian proprietary company as described in our Terms of Service's Pre-Incorporation & Beta Notice. This page applies to you if you are located in Australia.

2. Your Rights Under the Privacy Act

Under the Australian Privacy Principles, you have the right to:

  • Know how we collect, hold, use, and disclose your personal information (APP 1);
  • Access the personal information we hold about you (APP 12); and
  • Request correction of personal information you believe is inaccurate, out of date, incomplete, irrelevant, or misleading (APP 13).

3. Data Sovereignty

Spark's production infrastructure runs on Google Cloud's Australia (australia-southeast1) region. This is not a regional carve-out or optional configuration — it is where the Service actually operates by default, for every user regardless of location. Some limited third-party processors we rely on (for example, push-notification delivery) may involve infrastructure outside Australia as part of how that underlying service works; our own application and database infrastructure does not.

4. Australian Consumer Law

As described in our master Terms of Service, nothing in our agreements with you excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified.

5. How to Exercise Your Rights

You may exercise these rights by contacting us using the details in Section 7. We will respond within a reasonable period, consistent with the Privacy Act.

6. Complaints to the OAIC

You have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) if you believe our handling of your personal information violates the Privacy Act.
