This page supplements Spark's master Privacy Policy with disclosures required for visitors in Canada under the Personal Information Protection and Electronic Documents Act ("PIPEDA") and comparable provincial privacy laws. It does not restate rights already described in the master Privacy Policy — only what Canadian law adds.
1. Applicability
This page applies to you if you are located in Canada.
2. Your Rights Under Canadian Law
Under PIPEDA, you have the right to:
- Know why we collect, use, or disclose your personal information;
- Access the personal information we hold about you;
- Challenge the accuracy and completeness of that information, and have it amended as appropriate;
- Withdraw consent to our processing, subject to legal or contractual restrictions; and
- Be notified of a data breach that creates a real risk of significant harm to you.
3. Algorithmic Transparency
Spark's peer-verification and merit-evaluation features are driven by the independent judgment of other users, not by an automated decision system that determines outcomes on Spark's behalf. Spark does not use automated decision-making to make legal or similarly significant decisions about you (for example, account termination decisions are made by human review, consistent with our Terms of Service's enforcement provisions).
4. How to Exercise Your Rights
You may exercise these rights by contacting us using the details in Section 7. We will respond within a reasonable time, and in any event within the timeframe required by applicable Canadian law.
5. Complaints to the Privacy Commissioner
You have the right to file a complaint with the Office of the Privacy Commissioner of Canada if you believe our handling of your personal information violates PIPEDA.
6. Clause Overrides
Spark's Terms of Service designate the courts of South Australia and the Federal Court of Australia as the forum for disputes, since Spark is an Australian venture. If mandatory Canadian federal or provincial consumer-protection law grants you a non-waivable right to bring a claim in your home Canadian courts, that right is not overridden by this designation, and you may exercise it notwithstanding the Terms of Service.
