This page supplements Spark's master Privacy Policy with disclosures required for visitors in India under the Digital Personal Data Protection Act, 2023 ("DPDP Act"). It does not restate rights already described in the master Privacy Policy — only what Indian law adds.
1. Applicability
This page applies to you if you are located in India.
2. Your Rights Under the DPDP Act
As a Data Principal under the DPDP Act, you have the right to:
- Obtain a summary of the personal data we process about you, and the processing activities involved;
- Request correction, completion, updating, or erasure of your personal data;
- Withdraw your consent to processing at any time, as easily as you gave it;
- Have your grievances redressed through our Grievance Officer (Section 4); and
- Nominate another individual to exercise these rights on your behalf in the event of your death or incapacity.
3. How to Exercise Your Rights
You may exercise these rights by contacting our Grievance Officer (Section 4). We will respond within the timeframe required by the DPDP Act and its rules.
4. Grievance Officer
Spark's designated Grievance Officer for DPDP Act purposes can be reached at grievance@spark.bebulbed.com. We will acknowledge and respond to grievances within the timeframe prescribed by applicable rules under the DPDP Act.
5. Data Protection Board of India
If you are not satisfied with our response, you have the right to escalate your complaint to the Data Protection Board of India.
6. Clause Overrides
Spark's Terms of Service designate the courts of South Australia and the Federal Court of Australia as the forum for disputes, since Spark is an Australian venture. If mandatory Indian consumer-protection law grants you a non-waivable right to bring a claim in your home Indian courts or consumer forums, that right is not overridden by this designation, and you may exercise it notwithstanding the Terms of Service.
