This page supplements Spark's master Privacy Policy with disclosures required for visitors in Japan under the Act on the Protection of Personal Information ("APPI"). It does not restate rights already described in the master Privacy Policy — only what Japanese law adds.
1. Applicability
This page applies to you if you are located in Japan.
2. Your Rights Under the APPI
Under the APPI, you have the right to:
- Request disclosure of the personal information we hold about you;
- Request correction, addition, or deletion of that information if it is inaccurate; and
- Request suspension of use or erasure of your personal information if it was obtained unlawfully, is no longer needed for the purpose for which it was collected, or has otherwise been handled in violation of the APPI.
3. Cross-Border Data Transfers
Spark is an Australian venture, and its production infrastructure is hosted in Australia (Google Cloud's australia-southeast1 region), not within Japan (see our master Privacy Policy's Where We Process Your Information section). As required by the APPI when transferring personal information to a third party in a foreign country, we take steps to ensure the receiving country or the receiving party maintains a standard of data protection consistent with the APPI's requirements, and will provide additional information about Australia's data protection framework (the Privacy Act 1988 (Cth)) upon request.
4. How to Exercise Your Rights
You may exercise these rights by contacting us using the details in Section 6. We will respond within the timeframe required by the APPI.
5. Clause Overrides
Spark's Terms of Service designate the courts of South Australia and the Federal Court of Australia as the forum for disputes, since Spark is an Australian venture. If mandatory Japanese consumer-protection law grants you a non-waivable right to bring a claim in your home Japanese courts, that right is not overridden by this designation, and you may exercise it notwithstanding the Terms of Service.
